Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services offered by JobbWorks LLC ("JobbWorks," "we," "us," or "our") (collectively, the "Services"). By creating an account, clicking to accept these Terms, or using the Services, you agree to be bound by these Terms.

If you are using the Services on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity.

Description of the Services

JobbWorks LLC provides a cloud-based software platform for contractors and small businesses to manage operations such as jobs, estimates, invoices, customers, and related workflows. Features may change over time. We may add, modify, or discontinue functionality with reasonable notice where practicable. The Services do not constitute legal, tax, or accounting advice; you remain responsible for your own business decisions and compliance with applicable laws.

Accounts and responsibilities

  • You must provide accurate registration information and keep it up to date.
  • You are responsible for safeguarding your credentials and for all activity under your account.
  • You must promptly notify us of any unauthorized access or security incident.
  • You may not share accounts in a way that circumvents subscription or usage limits, or resell access to the Services except as expressly permitted in writing.
  • You are responsible for the content you upload and for obtaining any consents needed to process personal data of your customers or contacts in the Services.

Subscriptions, payments, and fees

Paid plans, trial periods, renewal terms, and pricing are presented at signup or on our pricing page and may change with notice as described in your order or plan terms. Unless stated otherwise, subscriptions renew automatically until canceled. You authorize us and our payment partners to charge your designated payment method for applicable fees and taxes.

Stripe and Stripe Connect. Payment and payout features may be provided by Stripe, Inc. and its affiliates, including Stripe Connect where merchants or connected accounts are involved. JobbWorks LLC is not the payment processorfor card transactions in the same manner as Stripe; payment processing is subject to the Stripe Connected Account Agreement, Stripe Services Agreement, and other Stripe terms that apply to your use of those features. Disputes, chargebacks, and funding timelines may be handled according to Stripe's rules and your bank or card issuer.

Refunds, if any, are governed by the refund policy stated at the time of purchase or in your agreement with us. Failure to pay may result in suspension or termination of access to paid features.

Acceptable use

You agree not to:

  • Use the Services in violation of law or regulation, or to facilitate illegal activity
  • Harass, threaten, defraud, or impersonate others
  • Upload malware, attempt unauthorized access to systems or data, or probe or scan our networks without permission
  • Reverse engineer the Services except to the limited extent permitted by applicable law
  • Use the Services to send unsolicited bulk communications in violation of anti-spam laws
  • Overload or interfere with the integrity or performance of the Services
  • Use the Services to build a competing product by scraping or systematically copying non-public aspects of the Services without our consent

We may investigate violations and cooperate with law enforcement as permitted by law.

Intellectual property

JobbWorks LLC and its licensors own all rights, title, and interest in the Services, including software, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Services for your internal business purposes during your subscription. You retain ownership of your content; you grant us a license to host, process, and display your content as needed to provide and improve the Services and as described in our Privacy Policy.

Confidentiality and feedback

Non-public information we disclose about the Services may be our confidential information. If you provide suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without obligation to you.

Termination

You may stop using the Services at any time. We may suspend or terminate your access if you materially breach these Terms, if we are required to do so by law, or if we discontinue the Services (with reasonable notice where feasible).

Upon termination, your right to use the Services ceases. Provisions that by their nature should survive (including payment obligations accrued before termination, intellectual property, disclaimers, and limitations of liability) will survive.

Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, in no event will JobbWorks LLC or its suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to the Services or these Terms, whether based in contract, tort, strict liability, or other theory, even if advised of the possibility of such damages.

Our aggregate liability for all claims arising out of or related to the Services or these Terms will not exceed the greater of (a) the amounts you paid to JobbWorks LLC for the Services in the twelve (12) months before the event giving rise to liability, or (b) one hundred U.S. dollars ($100), if you have not had payment obligations to us. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

Indemnity

You will defend, indemnify, and hold harmless JobbWorks LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of the Services, or your violation of these Terms or applicable law, except to the extent caused by our gross negligence or willful misconduct.

Governing law and venue

These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of law principles. You agree that the state and federal courts located in Wisconsin will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Services, subject to any mandatory arbitration or venue rules that cannot be waived by contract in your jurisdiction.

General

These Terms constitute the entire agreement between you and JobbWorks LLC regarding the Services and supersede prior agreements on the same subject. If a provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign without our consent. Notices may be sent to the email associated with your account or posted within the Services.
